This Website is run by ElektroPlug Group (Pty) Ltd (hereinafter “ElektroPlug”, “we”, “us”) based in South Africa and with registration number 2022/887364/07 as registered under the Companies Act 71 of 2008.

Per the Electronic Communications and Transactions Act, Act No. 25 of 2002 (ECT Act), the following Terms and Conditions (Ts&C’s) govern your use of www.elektroplug.co.za (“Website”) and its services as a customer and are binding on all persons visiting the Website or accessing any of ElektroPlug’s subscription services or physical subscription items.

If you have any questions about the Ts&Cs, or if you do not wish to accept them, our customer service will be available to you via email at [email protected]. Otherwise, refrain from signing any of our agreements and/or terminate use of the Website immediately. Any delay in terminating use will be regarded as your decisive consent to ElektroPlug’s Ts&Cs.

1. Important notices

This Agreement consists of the Ts&Cs applied to all contracts which are concluded by customers for subscription services and associated physical subscription items offered via the Website. The Customer is a consumer in terms of the Consumer Protection Act, Act No. 68 of 2008 (CPA).

2. Definitions

Upon reading this Agreement, note the following definitions as used in the Ts&Cs: 

“ElektroPlug”, “we”, or “us”, refers to ElektroPlug Group (Pty) Ltd, whichever one applies; 

“Website” refers to ElektroPlug’s website (www.elektroplug.co.za), Facebook store, or other ElektroPlug platforms that exist or are to exist with the function of providing our services to customers;

“Customer”, “you”, or “your” refers to any person who accesses or uses the website, and/or any person who enters into a contractual agreement with us.

“Subscription Agreement” or “Agreement” refers to a legally binding contract between ElektroPlug and the customer for the provision of our subscription services and the use of the associated subscription item(s). The purpose of the Agreement is to grant the customer exclusive use of the subscription item in exchange for the agreed-upon subscription fee.

“Concluding an Agreement”, “Agreement Conclusion”, or “Agreement Confirmation” denotes the formal stage in which ElektroPlug accepts the customer’s offer for our subscription services. This occurs subsequent to the customer placing an order via the Website and successfully completing the verification procedure.

“Subscription services”, or “our services” refers to the offerings from ElektroPlug encompassing the use of the subscription item and its accessories, and may extend to other intangible or tangible features associated with the service.

“Subscription item” or “subscription items” refers to the physical electronic device displayed on the Website, by which the Agreement Conclusion results in the transfer of use of the device to the customer in exchange for payment of the subscription fee. 

“Monthly subscription fee”, “subscription fee”, “subscription payment” pertains to the predetermined payment amount displayed on the offer page and agreed upon in the Agreement between the customer and ElektroPlug in exchange for the exclusive use of the subscription item.

“Subscription period” refers to the specified duration for which the customer is entitled to the exclusive of the subscription item, as agreed upon in the Agreement. The subscription period is determined by the selected option at the time of placing the order and may vary, including fixed periods such as 1, 3, 6, 12, or 18 months.

“ElektroCare” is ElektroPlug’s insurance service that encompasses protection benefits for the subscription item during the subscription period.

“Buyout” refers to the option available to the customer to purchase the subscription item after the end of the minimum subscription period, if applicable. Throughout the subscription period, the subscription item remains the property of ElektroPlug unless the customer makes an offer for undertaking the buyout process. In the case, ownership is transferred to the customer only upon successful payment of any remaining subscription fees and the designated buyout price.

2. Definitions

“Website” refers to ElektroPlug’s website (www.elektroplug.co.za), Facebook store, or other ElektroPlug platforms that exist or are to exist with the function of providing our services to customers;

“Customer”, “you”, or “your” refers to any person who accesses or uses the website, and/or any person who enters into a contractual agreement with us.

“Subscription Agreement” or “Agreement” refers to a legally binding contract between ElektroPlug and the customer for the provision of our subscription services and the use of the associated subscription item(s). The purpose of the Agreement is to grant the customer exclusive use of the subscription item in exchange for the agreed-upon subscription fee.

“Concluding an Agreement”, “Agreement Conclusion”, or “Agreement Confirmation” denotes the formal stage in which ElektroPlug accepts the customer’s offer for our subscription services. This occurs subsequent to the customer placing an order via the Website and successfully completing the verification procedure.

“Subscription services”, or “our services” refers to the offerings from ElektroPlug encompassing the use of the subscription item and its accessories, and may extend to other intangible or tangible features associated with the service.

“Subscription item” or “subscription items” refers to the physical electronic device displayed on the Website, by which the Agreement Conclusion results in the transfer of use of the device to the customer in exchange for payment of the subscription fee. 

“Monthly subscription fee”, “subscription fee”, “subscription payment” pertains to the predetermined payment amount displayed on the offer page and agreed upon in the Agreement between the customer and ElektroPlug in exchange for the exclusive use of the subscription item.

“Subscription period” refers to the specified duration for which the customer is entitled to the exclusive of the subscription item, as agreed upon in the Agreement. The subscription period is determined by the selected option at the time of placing the order and may vary, including fixed periods such as 1, 3, 6, 12, or 18 months.

“ElektroCare” is ElektroPlug’s insurance service that encompasses protection benefits for the subscription item during the subscription period.

“Buyout” refers to the option available to the customer to purchase the subscription item after the end of the minimum subscription period, if applicable. Throughout the subscription period, the subscription item remains the property of ElektroPlug unless the customer makes an offer for undertaking the buyout process. In the case, ownership is transferred to the customer only upon successful payment of any remaining subscription fees and the designated buyout price.

3. Use of third parties, privacy, and use of data

You agree that ElektroPlug may collect, use, and store your personal information according to our Privacy Policy and in line with the Protection of Personal Information Act, Act No. 4 of 2013 (POPI Act). We will not store your card details on our Website, which are entered by our customers on DPO’s PayGate’s secure website.

You agree that ElektroPlug may use third parties to assist in fulfilling part(s) of our subscription services. To that end, we may share customers’ personal information with said third parties for the exclusive purpose of providing our subscription services or physical subscription items to you.

You agree that ElektroPlug may send you marketing messages about our services, including but not limited to our subscription services, unless you indicate a preference not to receive such communications.

3. Use of third parties, privacy, and use of data

You agree that ElektroPlug may collect, use, and store your personal information according to our Privacy Policy and in line with the Protection of Personal Information Act, Act No. 4 of 2013 (POPI Act). We will not store your card details on our Website, which are entered by our customers on DPO’s PayGate’s secure website.

You agree that ElektroPlug may use third parties to assist in fulfilling part(s) of our subscription services. To that end, we may share customers’ personal information with said third parties for the exclusive purpose of providing our subscription services or physical subscription items to you.

You agree that ElektroPlug may send you marketing messages about our services, including but not limited to our subscription services, unless you indicate a preference not to receive such communications.

4. Account registration, orders for subscription services, and verification procedure

4.1 Account registration

You must register as a customer on our website to conclude an Agreement for our subscription services. Concluding an Agreement, for the purposes of our terms and conditions, refers to the customer placing an order for our subscription services via our Website, and our corresponding acceptance of the order through written email communication with the customer.

You may register when placing an order or independently from your order at an earlier time.

When registering for a user account, the customer is obliged to provide accurate personal data, namely: your legal name, address, email address, and payment information. You have an obligation to inform us of any modifications in your personal data as soon as possible.

To register for a user account and place an order on our Website, the consumer must be a natural person residing in the Republic of South Africa, be of legal age, and possess full contractual capacity. ElektroPlug shall verify the customer’s age upon authenticating their personal identity.

4.2 Placing an order for subscription services and Agreement Confirmation

Orders for ElektroPlug’s subscription services may exclusively be initiated online on our Website through an active user account. The subscription items associated with our services are brand new and may be unpacked exclusively for the purpose of uploading software for security services.

The customer can make an order by selecting the subscription item(s) and subscription period(s) on the offer page, also called product page, and clicking “Add to cart”. 

Upon choosing “Confirm order” on the order summary page, you are making a binding offer for the conclusion of an Agreement for ElektroPlug’s subscription services, which includes both tangible and intangible services, including but not limited to, access to physical subscription items, insurance coverage, and delivery. 

Placing an order shall be regarded as the customer’s unconditional acceptance of the monthly subscription fee and any associated fees exhibited on the offer page.

After placing an order, ElektroPlug will send you an email confirming the receipt of your order subject to change. Only after successfully verifying your identity, personal data, and banking information shall ElektroPlug process your order. Upon a successful check of your order, ElektroPlug will send you an email confirming the acceptance of your offer for the subscription item, referred to as “Agreement Confirmation”. 

The Agreement is effective only upon receipt of the Agreement Confirmation. The Agreement Confirmation email serves as a binding Agreement with ElektroPlug, delineating the applicable terms and conditions. This contractual relationship is governed by the laws of the Republic of South Africa, with any disputes subject to resolution in accordance with the legal provisions applicable in the jurisdiction. 

ElektroPlug is entitled to decline or cancel any order based on this Agreement and within the laws stipulated by the Republic of South Africa. This may include, but is not limited to, the requirement for additional verification or payment information before accepting any order.

ElektroPlug reserves the right to allocate payments for new orders by existing customers to their prior subscriptions if they are in arrears with their subscription fees.

4.3 Verification procedure and identity check

ElektroPlug undertakes a thorough verification procedure before accepting your subscription offer. For such verification purposes, the customer is obliged to provide us with an acceptable form of identification. We only accept original South African identity cards, green IDs and passports. 

To demonstrate good financial standing, ElektroPlug also requires your original bank statements covering the last three months.

This verification process may also include verification of your email address, phone number, residential address, and confirmation of your age. 

Failure to comply with these verification procedures may result in the rejection of your subscription request or the suspension of services in cases of subscription renewal. ElektroPlug reserves the right to take appropriate legal measures to ensure compliance.

You shall inform ElektroPlug of any changes in your data without delay. Such changes may include amendments in residential address, bank card, and phone number. Failure to comply with this obligation may result in the suspension of your subscription services.

4. Account registration, orders for subscription services, and verification procedure

5. Terms of delivery

5.1 Delivery to residential address

Subject to availability and receipt of subscription fee, the subscription item that is part of an Agreement Confirmation will be delivered to the residential address that you have provided when placing an order.

Upon Agreement Confirmation and the successful processing of your order, the customer will be sent a waybill number for tracking the order.

The customer shall be required to sign upon receipt of the subscription item. Refusal and/or inability to provide a signature by the customer who has made the order is deemed an unsuccessful delivery, which the customer will be held liable for. This may result in withdrawal of our Agreement Confirmation for our subscription services and/or the imposition of penalty fees or additional delivery charges.

5.2 Delivery periods estimations and out of stock subscription items

The delivery periods stated on the offer page and Agreement Confirmation email are estimates and only serve as approximations. If ElektroPlug surpasses the specified delivery by more than 20 days, each of the parties has the right to withdraw from the Agreement. If we have no fault in the delivery delay due to unforeseeable circumstances, ElektroPlug is entitled to withdraw from the Agreement. The customer will be notified of said delay immediately and any payments shall be refunded without delay. 

If ElektroPlug identifies that the subscription item ordered by you is not in stock, we will inform you by email of our inability to fulfil your order and your offer will be annulled. If ElektroPlug has accepted your offer for our subscription services by sending you an Agreement Confirmation via email, we have a right to withdraw from the Agreement. Your full refund to the original payment method will be processed immediately. Refer to Section 12.2 for details on the refund process.

5. Terms of delivery

5.1 Delivery to residential address

Subject to availability and receipt of subscription fee, the subscription item that is part of an Agreement Confirmation will be delivered to the residential address that you have provided when placing an order.

Upon Agreement Confirmation and the successful processing of your order, the customer will be sent a waybill number for tracking the order.

The customer shall be required to sign upon receipt of the subscription item. Refusal and/or inability to provide a signature by the customer who has made the order is deemed an unsuccessful delivery, which the customer will be held liable for. This may result in withdrawal of our Agreement Confirmation for our subscription services and/or the imposition of penalty fees or additional delivery charges.

5.2 Delivery periods estimations and out of stock subscription items

The delivery periods stated on the offer page and Agreement Confirmation email are estimates and only serve as approximations. If ElektroPlug surpasses the specified delivery by more than 20 days, each of the parties has the right to withdraw from the Agreement. The customer will be notified of said delay immediately and any payments shall be refunded without delay. 

If ElektroPlug identifies that the subscription item ordered by you is not in stock, we will inform you by email of our inability to fulfil your order and your offer will be annulled. If ElektroPlug has accepted your offer for our subscription services by sending you an Agreement Confirmation via email, we have a right to withdraw from the Agreement. Your full refund to the original payment method will be processed immediately. Refer to Section 12.2 for details on the refund process.

6. Subscription periods, renewal of subscription, and amendments to subscription

6.1 Subscription periods 

ElektroPlug provides fixed periods for our subscription service with the following durations: 1, 3, 6, 12, and 18 months. The subscription period is dependent on the option you chose when placing an order. In the absence of a different provision, the Agreement will remain valid indefinitely.

A minimum subscription period may be applicable and will be explicitly specified in relevant advertisements and/or on the offer page.

The subscription period shall start on the day of the delivery of the subscription item. The customer shall pay ElektroPlug the monthly subscription fee for the duration of the subscription period.

6.2 Renewal of subscription 

Your subscription will automatically renew after the end of the subscription period, converting into a month-by-month arrangement, unless you or ElektroPlug terminate the subscription following the prescribed termination process in Section 11. 

ElektroPlug shall debit the monthly subscription fee via the credit card or debit card we have on file for you on the same date as previously agreed upon, ordinarily the date that the order was made. 

6.3 Amendments to subscriptions 

You may amend your subscription, which refers to upgrading or downgrading a subscription item. This will be possible at the elapse of the minimum subscription period for your current subscription item and after we receive all payments associated with your current subscription Agreement.

Modifications to your subscription must be initiated by contacting our customer service team at [email protected]

You may be requested to undergo the verification process upon requesting an amendment to your subscription.

You assume financial liability for the price difference when amending your subscription.

ElektroPlug retains the unilateral right to amend subscriptions based on stock availability or reasonable limitations. We may offer, at our sole discretion, a discount due to subscription amendments.

6. Subscription periods, renewal of subscription, and amendments to subscription

ElektroPlug provides fixed periods for our subscription service with the following durations: 1, 3, 6, 12, and 18 months. The subscription period is dependent on the option you chose when placing an order. In the absence of a different provision, the Agreement will remain valid indefinitely.

The subscription period shall start on the day of the delivery of the subscription item. The customer shall pay ElektroPlug the monthly subscription fee for the duration of the subscription period.

You may be requested to undergo the verification process upon requesting an amendment to your subscription.

7. Monthly subscription fees, ownership of subscription item, and buyout 

7.1 Monthly subscription fees 

Customers are obligated to pay a monthly subscription fee for access to the subscription item, as displayed in South African Rand (ZAR) on the offer page and the order summary page when making an order. 

The customer shall make the first payment of the subscription fee upon the conclusion of the Agreement per our Agreement Confirmation email and before the delivery or handover of the subscription item.

The day of order approval shall serve as the debit date for the entire subscription period per this Agreement, unless otherwise agreed upon in writing by the customer and us.

Subscription fees remain fixed throughout a subscription period unless a promotion was applied. Nonetheless, ElektroPlug reserves the right, at our sole discretion, to change subscription fees at the end of a minimum subscription period. We will notify you at least 20 days before the change takes effect. If you disagree with the change, you can cancel the contract up to 2 weeks before the subscription change takes effect. Unless you formally inform our customer service team of your intention to terminate your subscription, ElektroPlug assumes that you are in agreement with the subscription fee change.

7.2 Ownership of subscription item

During the subscription period, ElektroPlug shall remain the lawful owner of the subscription item attached to the subscription service.

To that end, the customer may not alienate the subscription item or transfer it for use to another third party. The customer may not sell, lend, or give away the subscription item. During the subscription period, you also may not use the subscription item as an object of transaction, and, in particular, lease or lien the subscription item.

Directly at the end of the subscription period, the customer shall return the subscription item(s) to its lawful owner, ElektroPlug, per Section 8.

7.3. Buyout of subscription item

The customer may buyout the subscription item after the end of the minimum subscription period. You shall express your intention to purchase the subscription item to [email protected], before the end of your subscription period whereby we will confirm whether you qualify for purchasing the item. This is dependent on, among other things, successful completion of all subscription fee payments up to date.

Ownership of the subscription item is transferred to you once you have paid the complete buyout price. 

Upon successful payment of the buyout price, ElektroPlug will send you a letter of ownership for the subscription item that you have bought.

Once the ownership has been transferred to you, you will lose access to ElektroCare’s protection and respective benefits.

7. Monthly subscription fees, ownership of subscription item, and buyout 

7.1 Monthly subscription fees 

Customers are obligated to pay a monthly subscription fee for access to the subscription item, as displayed in South African Rand (ZAR) on the offer page and the order summary page when making an order. 

The customer shall make the first payment of the subscription fee upon the conclusion of the Agreement per our Agreement Confirmation email and before the delivery or handover of the subscription item.

The day of order approval shall serve as the debit date for the entire subscription period per this Agreement, unless otherwise agreed upon in writing by the customer and us.

Nonetheless, ElektroPlug reserves the right, at our sole discretion, to change subscription fees at the end of a minimum subscription period. We will notify you at least 20 days before the change takes effect. If you disagree with the change, you can cancel the contract up to 2 weeks before the subscription change takes effect. Unless you formally inform our customer service team of your intention to terminate your subscription, ElektroPlug assumes that you are in agreement with the subscription fee change.

7.2 Ownership of subscription item

During the subscription period, ElektroPlug shall remain the lawful owner of the subscription item attached to the subscription service.

To that end, the customer may not alienate the subscription item or transfer it for use to another third party. The customer may not sell, lend, or give away the subscription item. During the subscription period, you also may not use the subscription item as an object of transaction, and, in particular, lease or lien the subscription item.

Directly at the end of the subscription period, the customer shall return the subscription item(s) to its lawful owner, ElektroPlug, per Section 8.

7.3. Buyout of subscription item

The customer may buyout the subscription item after the end of the minimum subscription period. You shall express your intention to purchase the subscription item to [email protected], before the end of your subscription period whereby we will confirm whether you qualify for purchasing the item. This is dependent on, among other things, successful completion of all subscription fee payments up to date.

Ownership of the subscription item is transferred to you once you have paid the complete buyout price. 

Upon successful payment of the buyout price, ElektroPlug will send you a letter of ownership for the subscription item that you have bought.

Once the ownership has been transferred to you, you will lose access to ElektroCare’s protection and respective benefits.

8. Return of the subscription item

8.1 Requirements for return at the end of the subscription period

Directly at the end of the subscription period, the customer shall return the subscription item to ElektroPlug in its original box, including all equipment they received with the subscription item. 

The subscription item shall be returned in the same condition it was at the beginning of the subscription period, except for reasonable signs of use, as outlined in Section 14. 

You are obligated to remove any and all passwords, personal accounts, or other protection methods that prohibit third parties from accessing the subscription item prior to returning it. 

8.2 Ramifications for non-compliance with return requirements

If you fail to return the subscription item within 14 days after the end of the subscription period, we reserve the right, at our sole discretion, to charge you the salvage value of the subscription item which shall be calculated according to the current market value, without waiving any of our rights to claim damages.

In the event that you return the subscription item without the original box and/or without the equipment included with the subscription item, ElektroPlug shall notify you of your obligations and request to send the missing components. You shall be obligated to ship the missing components within 7 days from our request. If more than 7 days after the request elapse, and you have not shipped the missing components, ElektroPlug reserves the right, at our sole discretion, to charge you the salvage value of the missing components, without waiving any of our rights to claim damages.

If the subscription item you return is not in the same condition it was at the beginning of your subscription period, except for reasonable signs of use, ElektroPlug reserves the right, at our sole discretion, to charge you for the cost of repairing the subscription item, which shall be calculated based on our insurers’ evaluation, without waiving any of our rights to claim damages. This is derived from our ElektroCare policy, whereby you lose access to insurance the last day of your subscription period, and you are obliged to inform us of any damages to the subscription item within one week of said damage.

In the event that you return the subscription item with passwords, personal accounts, or other protection methods that prohibit third parties from accessing the subscription item, ElektroPlug reserves the right to unblock the subscription item and/or remove personal accounts at your own cost, which is a fixed fee of 1,100 ZAR. 

8. Return of the subscription item

8.1 Requirements for return at the end of the subscription period

Directly at the end of the subscription period, the customer shall return the subscription item to ElektroPlug in its original box, including all equipment they received with the subscription item.

9. Terms of payment and default

9.1. Terms of payment

You acknowledge and agree to pay the monthly subscription fee for the subscription item you subscribed to upon completing your order. 

ElektroPlug, as the service provider, shall facilitate the settlement of the payment. Payments for our subscription services may be made via Visa, MasterCard, Diners, or American Express Cards. 

Card transactions will be acquired for ElektroPlug through PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Customers may go to www.paygate.co.za to view their security certificate and security policy. 

For payments via the above payment methods, the customer must be the lawful cardholder. 

The credit card or debit card shall be charged upon ElektroPlug’s acceptance of your offer and before the handover of the subscription item, denoted by the receipt of an Agreement Confirmation email. 

9.2. Authorization for recurring payments and fee adjustments

By accepting this agreement, you authorise the automatic deduction of the monthly subscription fee from the designated payment method we have on record, which will occur on the same day as the order date each subsequent month throughout the period of your subscription. Automatic billing will continue until termination of the subscription subject to Section 11.

You authorise ElektroPlug to debit the payment method we have on record in the following instances:

  • Modification for any payment errors, both on part of the customer and us;

  • Correcting payment reversals for invalid transactions; 

  • Rectifications for any dishonoured deposits;

  • Payment adjustment for any fraudulent or unlawful activities;

  • Any and all fees associated with ElektroPlug’s subscription services, including but not limited to: subscription fees, late payment fees, payment default fees, subscription amendment fees, collection fees, and failure to return device in its original condition and to remove personal accounts fees. 

9.3. Defaults on subscription fees

In case of defaults on payment, ElektroPlug reserves the right, at our sole discretion, to charge a late payment fee or a pro-rata default interest fee for overdue payments, as permissible by South African laws. ElektroPlug holds the right to prove that damages are higher than initially stated.

If payment is not received within 24 hours after the payment due date, ElektroPlug shall designate the customer as a default payer for the outstanding fees and the total value of the subscribed item. To that end, ElektroPlug shall provide you with written notice of your obligation to pay your due and outstanding debts. 

If more than 14 days after the official notification elapses and payment has not been received, ElektroPlug reserves the right, at our sole discretion, to assign the account to a third party, acting as an authorised representative to collect all outstanding payments, fees and/or value of subscribed item. 

ElektroPlug retains the legal authority to withhold customer funds if the customer fails to return the subscription item or fulfil the outstanding payments and/or fees. 

ElektroPlug also reserves the right to engage a third party collection group to assist in the lawful collection process of the subscription item, associated accessories, and/or components if they are not recovered within the stipulated time frame.

9. Terms of payment and default

You acknowledge and agree to pay the monthly subscription fee for the subscription item you subscribed to upon completing your order.

ElektroPlug retains the legal authority to withhold customer funds if the customer fails to return the subscription item or fulfil the outstanding payments and/or fees. 

ElektroPlug also reserves the right to engage a third party collection group to assist in the lawful collection process of the subscription item, associated accessories, and/or components if they are not recovered within the stipulated time frame.

10. Temporary interruption of subscription services, early termination, and collection process 

10.1 Temporary interruption of subscription services

ElektroPlug reserves the right to temporarily interrupt our subscription services by employing any reasonable measures stipulated below, included but not limited to, locking your subscription item and/or network access, in the following cases:

  • Defaulting on a subscription payment;

  • Failure to abide by ElektroPlug’s Ts&Cs or any other respective agreements associated with our subscription services or company policies;

  • Early termination of this Agreement and the permanent suspension of our services to you for reasons outlined in Section 10.2;

  • Theft or loss of the subscription item;

  • Upon instruction to do so by the Financial Sector Conduct Authority.

ElektroPlug reserves the right to charge a fee in cases of temporary suspension of our subscription services to you, which may relate to costs incurred when locking and unlocking the subscription item or any other fees that may arise.

In cases where a customer defaults on a payment after 24 hours of the due date, ElektroPlug shall be entitled to employ any reasonable measures as a means to temporarily interrupt your access to our subscription services. This includes locking the subscription item(s) and/or network access, and other actions which may impact both the unpaid subscription item(s) and/or other subscription item(s) associated with the customer. 

We shall not be held responsible for any damages or loss of data resulting from any of the aforementioned reasonable measures employed to temporarily interrupt the customer’s access to ElektroPlug’s subscription services.

Upon satisfaction of outstanding payments following interruption of our subscription services within the agreed upon time frame, ElektroPlug shall unlock the subscription item(s) and/or network within 24 hours.

In cases of continued payment failure despite our notice and interruption of our subscription services, ElektroPlug shall proceed with the early termination of the Agreement, per Section 10.2, and formal collection process for outstanding payments and the subscription item, per Section 10.3.

10.2. Early termination of subscription Agreement

ElektroPlug reserves the right of early termination of the Agreement for our subscription services for good cause. 

Early termination shall ensue if the customer fails to abide by ElektroPlug’s Ts&Cs, principally their obligations per the Agreement, and continues refusing to amend their failure despite having received an official notice from us to abide by our Agreement’s obligations within a specified timeframe. In particular, termination of the Agreement may occur if:

  • The customer has repeatedly failed to make subscription fee payment on the due date; 

  • The customer’s subscription fee payment is late, even after having received a warning about payment delays;

  • The customer infringes upon our ownership rights by transferring the subscription item to a third party without prior consent or subjecting the subscription item to substantial risk.

In the case that ElektroPlug terminates the Agreement for the aforementioned violations, the customer shall be held liable for paying all unsettled subscription fee payment and/or dues that are incurred as a result of us correcting your breach of the Agreement. This may include fees for extraordinary termination, the value of which shall be decided upon at our sole discretion dependent on the specific circumstance surrounding termination and your respective violation of the Agreement. 

10.3. Collection process of payments and the subscription item

If the customer engages in a material breach of the Agreement or is in arrears with the subscription fee payment, ElektroPlug shall have a right to recover payments any and/or all parts of our subscription services, which includes the subscription item, associated accessories, and/or components. 

ElektroPlug is entitled to engage a third party collection service to assist in the collection process on our behalf. 

The customer is obliged to remove any and all passwords, personal accounts, or other protection methods that prohibit third parties from accessing the subscription item prior to the collection of said item. 

If you return the subscription item with passwords, personal accounts, or other protection methods that prohibit third parties from accessing the subscription item, ElektroPlug reserves the right to unblock the subscription item(s) and/or remove personal accounts at your own cost, which is a fixed fee of R 1,100. 

10. Temporary interruption of subscription services, early termination, and collection process

ElektroPlug reserves the right to temporarily interrupt our subscription services by employing any reasonable measures stipulated below, included but not limited to, locking your subscription item and/or network access, in the following cases:

If you return the subscription item with passwords, personal accounts, or other protection methods that prohibit third parties from accessing the subscription item, ElektroPlug reserves the right to unblock the subscription item(s) and/or remove personal accounts at your own cost, which is a fixed fee of R 1,100. 

11. Ordinary termination of agreement 

ElektroPlug and the customer have the right to terminate the Agreement by providing a notice at least 20 days before the end of a subscription month, regarded as the day by which your subscription payment fee is withdrawn every month. If a minimum subscription term is applicable per the Agreement, termination shall only be possible at the earliest with a notice period of 20 days before the end of the minimum subscription term of the Agreement. 

The customer may terminate the Agreement by informing us on [email protected] as of the relevant date as prescribed above. Upon our processing of the termination request, you shall return the subscription item immediately after the end of the subscription period, as outlined in Section 8.

11. Ordinary termination of agreement 

ElektroPlug and the customer have the right to terminate the Agreement by providing a notice at least 20 days before the end of a subscription month, regarded as the day by which your subscription payment fee is withdrawn every month. If a minimum subscription term is applicable per the Agreement, termination shall only be possible at the earliest with a notice period of 20 days before the end of the minimum subscription term of the Agreement. 

The customer may terminate the Agreement by informing us on [email protected] as of the relevant date as prescribed above. Upon our processing of the termination request, you shall return the subscription item immediately after the end of the subscription period, as outlined in Section 8.

12. Cancellation of the agreement and refunds

12.1 Right to cancel, incurred fees, and return of subscription item

You possess the right to cancel the Agreement within five business days from the day of the Agreement’s conclusion without providing a statement of reasons. 

To withdraw, the customer must notify ElektroPlug’s customer services team at [email protected].

The cancellation of the Agreement takes effect from your subsequent billing date, whereby ElektroPlug will subsequently process your refund. Cancellation is free, but you will be charged a 5% administration fee. 

Refunds will strictly be made to the payment method used when making your order. A refund may take up to seven days from the day on which we received your Withdrawal request to reflect in your bank account.

In the case that the subscription item was delivered to you, we reserve the right to not process the refund until the item is received by ElektroPlug. The item must be returned to us without delay and at the latest within two business days from the day we received your intention to cancel the Agreement. You will be responsible for incurring the cost of the return shipment of the subscription item.

Upon return, the subscription item must be unused and in the same condition as it was upon delivery, including but not limited to, retaining the item’s seal, if applicable. If ElektroPlug finds the item to be used and/or not in the same condition as that upon delivery, we have a right to refuse your refund. ElektroPlug also may require you to pay the value of the subscription item in full in case of abuse of your right to cancel the Agreement, without prejudice to any rights to claim damages. 

ElektroPlug and/or any of our suppliers, or affiliated entities will not be held responsible for any liability that may arise during the cancellation or refund process.

12.2 Refunds

With the exception of the case outlined above, refunds are not possible unless:

  1. ElektroPlug identifies that the subscription item ordered by you is not in stock. In such situations, we will inform you by email of our inability to fulfil your order and your full refund to the original payment method will be processed immediately;

  2. ElektroPlug perceives exceptional circumstances, which will be evaluated individually. If applicable, ElektroPlug may grant a proportional refund.

12. Cancellation of the agreement and refunds

12.1 Right to cancel, incurred fees, and return of subscription item

You possess the right to cancel the Agreement within five business days from the day of the Agreement’s conclusion without providing a statement of reasons. 

To withdraw, the customer must notify ElektroPlug’s customer services team at [email protected].

The cancellation of the Agreement takes effect from your subsequent billing date, whereby ElektroPlug will subsequently process your refund. Cancellation is free, but you will be charged a 5% administration fee.

ElektroPlug and/or any of our suppliers, or affiliated entities will not be held responsible for any liability that may arise during the cancellation or refund process.

12.2 Refunds

With the exception of the case outlined above, refunds are not possible unless:

  1. ElektroPlug identifies that the subscription item ordered by you is not in stock. In such situations, we will inform you by email of our inability to fulfil your order and your full refund to the original payment method will be processed immediately;

  2. ElektroPlug perceives exceptional circumstances, which will be evaluated individually. If applicable, ElektroPlug may grant a proportional refund.

13. Damage and loss of subscription item

ElektroPlug expects that, other than normal wear and tear, you will return the subscription item at the end of your subscription period in the same condition in which you received it as outlined in Section 14. 

In the case of loss or damage greater than wear and tear, you are required to notify ElektroPlug within 2 business days of the incident involving the loss or damage of the subscription item. 

If the subscription item includes ElektroCare, you will be held liable for paying 10% of the damage cost. Refer to Section 14 to understand your obligations and rights concerning ElektroCare.

In case of intentional damage or loss of the subscription item (whether intentional or accidental), you will be required to pay the residual value of the subscription item in full, which shall be calculated according to the current market value. ElektroPlug reserves our rights to claim further damages.

You acknowledge that the loss or damage of the subscription item does not grant you the right to withhold any payment owed to ElektroPlug, regardless of whether such loss or damage is intentional or resulting from negligence.

You are responsible for continuing to pay your monthly subscription fees and/or other associated payments to ElektroPlug for our subscription services in the event of loss or damage.

13. Damage and loss of subscription item

ElektroPlug expects that, other than normal wear and tear, you will return the subscription item at the end of your subscription period in the same condition in which you received it as outlined in Section 14. 

In the case of loss or damage greater than wear and tear, you are required to notify ElektroPlug within 2 business days of the incident involving the loss or damage of the subscription item. 

If the subscription item includes ElektroCare, you will be held liable for paying 10% of the damage cost. Refer to Section 14 to understand your obligations and rights concerning ElektroCare.

In case of intentional damage or loss of the subscription item (whether intentional or accidental), you will be required to pay the residual value of the subscription item in full, which shall be calculated according to the current market value. ElektroPlug reserves our rights to claim further damages.

You acknowledge that the loss or damage of the subscription item does not grant you the right to withhold any payment owed to ElektroPlug, regardless of whether such loss or damage is intentional or resulting from negligence.

You are responsible for continuing to pay your monthly subscription fees and/or other associated payments to ElektroPlug for our subscription services in the event of loss or damage.

14. ElektroCare

ElektroCare is an inclusive service provided with your subscription item, ensuring comprehensive coverage for specific damages during the subscription item usage.

By accepting and using ElektroPlug Care, you agree to the following:

  • ElektroCare offers coverage for electrical malfunctions, plug and cord issues, and technical faults (“Damages”). However, damages resulting from intentional misuse, unauthorised modifications, or exposure to extreme environmental conditions are not covered.

  • ElektroCare does not cover damages deemed irreparable, unauthorised third-party repairs, or losses arising from theft or intentional damage. In such cases, you are responsible for covering the residual value of the subscription item, defined as its market price at the time of assessment, along with the subscription item fee for the month in which the damage is reported.

  • ElektroCare is applicable only for products returned to ElektroPlug for repair. Third-party repairs are not eligible for reimbursement under this care plan.

  • Each ElektroCare plan allows for up to two claims within a 12-month period for each covered product.

While ElektroCare is inclusive, you acknowledge that misuse, intentional damage, or unauthorised modifications are not covered. In such instances, you are responsible for covering the residual value of the item and the product’s rental cost for the month in which the damage is reported.

ElektroCare offers 90% coverage, leaving you responsible for only 10% of the total damages.

In the case of damage, theft, or loss, the customer has an obligation to inform ElektroPlug immediately in writing of all the details of the incident that caused the damage or other issues of the subscription item.

14. ElektroCare

ElektroCare is an inclusive service provided with your subscription item, ensuring comprehensive coverage for specific damages during the subscription item usage.

By accepting and using ElektroPlug Care, you agree to the following:

  • ElektroCare offers coverage for electrical malfunctions, plug and cord issues, and technical faults (“Damages”). However, damages resulting from intentional misuse, unauthorised modifications, or exposure to extreme environmental conditions are not covered.

  • ElektroCare does not cover damages deemed irreparable, unauthorised third-party repairs, or losses arising from theft or intentional damage. In such cases, you are responsible for covering the residual value of the subscription item, defined as its market price at the time of assessment, along with the subscription item fee for the month in which the damage is reported.

  • ElektroCare is applicable only for products returned to ElektroPlug for repair. Third-party repairs are not eligible for reimbursement under this care plan.

  • Each ElektroCare plan allows for up to two claims within a 12-month period for each covered product.

While ElektroCare is inclusive, you acknowledge that misuse, intentional damage, or unauthorised modifications are not covered. In such instances, you are responsible for covering the residual value of the item and the product’s rental cost for the month in which the damage is reported.

ElektroCare offers 90% coverage, leaving you responsible for only 10% of the total damages.

In the case of damage, theft, or loss, the customer has an obligation to inform ElektroPlug immediately in writing of all the details of the incident that caused the damage or other issues of the subscription item.

15. Liability

You indemnify and hold ElektroPlug and each company within the ElektroPlug Group harmless against any expense, loss, claim, harm, or damage brought against, suffered, or sustained by ElektroPlug or any company within the ElektroPlug Group, which arises directly or indirectly out of a breach of the terms of this Agreement by you or by your use of our Services and/or the subscription item, other than in respect of losses caused by the negligence or intentional misconduct of ElektroPlug or any company within the ElektroPlug Group or any of their respective employees, directors, or agents.

Without affecting the generality of 19.1 above, ElektroPlug shall not be liable to you for any breach of this Agreement or failure on ElektroPlug’s part to perform any obligations as a result of technical problems relating to the subscription item, termination of any licence to operate or use the software, act of God, government control, restrictions or prohibitions or other government act or omission, whether local or national, industrial disputes, or any other cause beyond the control of ElektroPlug.

15. Liability

You indemnify and hold ElektroPlug and each company within the ElektroPlug Group harmless against any expense, loss, claim, harm, or damage brought against, suffered, or sustained by ElektroPlug or any company within the ElektroPlug Group, which arises directly or indirectly out of a breach of the terms of this Agreement by you or by your use of our Services and/or the subscription item, other than in respect of losses caused by the negligence or intentional misconduct of ElektroPlug or any company within the ElektroPlug Group or any of their respective employees, directors, or agents.

16. Your undertakings

By consenting to this Agreement and accessing ElektroPlug’s subscription services, you undertake the following commitments:

You agree to abide by all usage guidelines and instructions provided by ElektroPlug concerning the proper use of our services and subscription items.

You undertake not to commercially exploit ElektroPlug’s services in any manner without prior written consent. This includes, but is not limited to, transferring subscription items to third parties.

You commit to providing ElektroPlug with all necessary and relevant information that may be reasonably and lawfully required to facilitate the seamless provision of our subscription services.

You agree to interact with ElektroPlug and our team members in a respectful and cordial manner at all times.

You are responsible for the proper care and safekeeping of subscription items provided through ElektroPlug. Any damage or loss resulting from negligence may incur additional charges, as outlined in Section 17.

You undertake to promptly report any issues, malfunctions, or damages to ElektroPlug’s customer support at help @elektroplug.co.za to facilitate timely resolution.

Your subscription is contingent upon your adherence to the Agreement outlined by ElektroPlug. Any violation may result in the enforcement of ElektroPlug’s policies.

You agree to use ElektroPlug’s subscription services in compliance with all applicable laws and regulations in the Republic of South Africa.

16. Your undertakings

In the event of unforeseen delays, we will communicate transparently and work diligently to resolve any issues.

ElektroPlug prioritises the security of your personal information and has robust measures in place to safeguard your data. We shall take all reasonable steps to protect the personal information of our customers. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).

Importantly, any subscription is bound by the terms applicable at the time of the order confirmation, ensuring clarity regarding the terms governing your ElektroPlug subscription.
