Payments
Terms of payment
You acknowledge and agree to pay the monthly subscription fee for the subscription item you subscribed to upon completing your order.
ElektroPlug, as the service provider, shall facilitate the settlement of the payment. Payments for our subscription services may be made via Visa, MasterCard, Diners, or American Express Cards.
Card transactions will be acquired for ElektroPlug through PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Customers may go to www.paygate.co.za to view their security certificate and security policy.
For payments via the above payment methods, the customer must be the lawful cardholder.
The credit card or debit card shall be charged upon ElektroPlug’s acceptance of your offer and before the handover of the subscription item, denoted by the receipt of an Agreement Confirmation email.
Authorization for recurring payments and fee adjustments
By accepting this agreement, you authorise the automatic deduction of the monthly subscription fee from the designated payment method we have on record, which will occur on the same day as the order date each subsequent month throughout the period of your subscription. Automatic billing will continue until termination of the subscription subject to Section 11.
You authorise ElektroPlug to debit the payment method we have on record in the following instances:

Modification for any payment errors, both on part of the customer and us;

Correcting payment reversals for invalid transactions;

Rectifications for any dishonoured deposits;

Payment adjustment for any fraudulent or unlawful activities;

Any and all fees associated with ElektroPlug’s subscription services, including but not limited to: subscription fees, late payment fees, payment default fees, subscription amendment fees, collection fees, and failure to return device in its original condition and to remove personal accounts fees.
Defaults on subscription fees
In case of defaults on payment, ElektroPlug reserves the right, at our sole discretion, to charge a late payment fee or a pro-rata default interest fee for overdue payments, as permissible by South African laws. ElektroPlug holds the right to prove that damages are higher than initially stated.
If payment is not received within 24 hours after the payment due date, ElektroPlug shall designate the customer as a default payer for the outstanding fees and the total value of the subscribed item. To that end, ElektroPlug shall provide you with written notice of your obligation to pay your due and outstanding debts.
If more than 14 days after the official notification elapses and payment has not been received, ElektroPlug reserves the right, at our sole discretion, to assign the account to a third party, acting as an authorised representative to collect all outstanding payments, fees and/or value of subscribed item.
ElektroPlug retains the legal authority to withhold customer funds if the customer fails to return the subscription item or fulfil the outstanding payments and/or fees.
ElektroPlug also reserves the right to engage a third party collection group to assist in the lawful collection process of the subscription item, associated accessories, and/or components if they are not recovered within the stipulated time frame.
